Nursing Home Neglect
Several of the members of Butler, Vines and Babb litigate nursing home cases on behalf of elderly clients and their families. Neglect and abuse happens with increasing frequency as the population of Americans requiring long-term care grows.
Families are faced with difficult choices regarding nursing home care for elderly or disabled relatives. Unfortunately, some nursing homes violate the trust that families have placed in them by providing substandard care. Nursing home patients and their families have a right to expect that elderly and dependent adults living in nursing homes should receive appropriate and respectful care, tailored to the individual's nursing and medical needs. While state and federal laws require nursing homes to provide a minimal level of care in the areas of nutrition, hygiene and nursing care, many facilities fall short of these basic requirements.
Nursing home neglect takes many forms: painful bed sores, inadequate personal hygiene and nutrition, broken bones and injuries from unexplained falls, and failure to monitor the administration of medication just to name a few. Nursing home abuse or neglect frequently occurs in facilities that are understaffed. Some nursing home corporations choose to cut staffing to save money while compromising minimum levels of care provided to nursing home residents. Nursing home patients are left unattended and minimum levels of are not provided . . . and loved ones living in nursing homes suffer unnecessarily as a result.
